Abo Capital (“Abo Capital,” “we,” “us,” or “our”) is a licensed mortgage brokerage. This Privacy Policy explains how we collect, use, share, and protect information when you visit abocapital.com (the “Site”), contact us, or apply for financing through us.

2. Scope of This Policy

This policy covers two related but distinct situations:

  • Site visitors. Anyone browsing abocapital.com or using the contact form or chat assistant.
  • Applicants and customers. Anyone who applies for or obtains a mortgage loan through us.

As a mortgage broker, we are a “financial institution” under the federal Gramm-Leach-Bliley Act (GLBA). Information we collect in connection with a loan application is governed by the GLBA Privacy Notice in Section 6 below, which controls in the event of any conflict with this policy.


3. Information We Collect

3.1 Information You Give Us Directly

When you use our contact form, chat assistant, or speak with us:

  • Name, email address, phone number
  • The substance of your message or scenario description
  • Text-message consent preference, if you provide it

When you apply for a loan (through our loan application portal, by email, or in conversation):

  • Social Security number and date of birth
  • Income, employment, and self-employment information
  • Bank account, asset, and investment information
  • Property address, value, and occupancy details
  • Existing debts, mortgages, and payment history
  • Entity documentation for business-purpose loans (LLC/corporate records, operating agreements)
  • Identification documents

3.2 Information We Collect From Others

To evaluate and place a loan, we obtain information from third parties, including:

  • Consumer reporting agencies (credit reports and scores)
  • Employers, banks, and other parties who verify information you provide
  • Appraisers, title companies, escrow companies, and insurers
  • Wholesale lenders and investors evaluating your file
  • Public records

3.3 Information Collected Automatically

When you visit the Site, our web server and hosting provider automatically log standard technical data, including IP address, browser type, referring page, and pages viewed. This is used for security, troubleshooting, and site reliability.

We do not currently run advertising pixels, remarketing tags, session-recording tools, or third-party analytics on this Site. See Section 8 for details on cookies.


4. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiry and discuss loan scenarios with you
  • Evaluate your qualifications and match you to loan programs
  • Submit your application to wholesale lenders and investors on your behalf
  • Process, underwrite, and close your loan
  • Verify your identity and prevent fraud
  • Comply with federal and state lending, licensing, recordkeeping, and reporting obligations
  • Communicate with you about your application, including by phone, email, and — with your consent — text message
  • Operate, secure, and improve the Site

We do not sell your personal information. We do not share your information with third parties for their own marketing purposes.


5. How We Share Your Information

We share your information only as needed to do the work you have asked us to do, or as the law requires or permits:

  • Wholesale lenders and investors. As a broker, we place your loan with a lender. Submitting your application to those lenders is the core of our service, and your information is shared with them for that purpose.
  • Settlement service providers. Title companies, escrow companies, appraisers, insurers, and closing agents involved in your transaction.
  • Service providers. Vendors who operate our systems on our behalf under contract — loan origination software, email delivery, website hosting, and the provider that powers our chat assistant.
  • Consumer reporting agencies. In connection with your credit report and, where applicable, reporting.
  • Legal and regulatory. Regulators, auditors, law enforcement, and courts, in response to subpoenas, court orders, examinations, or as otherwise required by law.

Financial companies choose how they share your personal information. Federal law gives consumers the right to limit some but not all sharing. Federal law also requires us to tell you how we collect, share, and protect your personal information. Please read this notice carefully to understand what we do.

What?
The types of personal information we collect and share depend on the product or service you have with us. This information can include:

  • Social Security number and income
  • Account balances and payment history
  • Credit history and credit scores
  • Assets, employment information, and transaction history

What We Do

How does Abo Capital protect my personal information?
To protect your personal information from unauthorized access and use, we use security measures that comply with federal law. These measures include computer safeguards, encrypted transmission and storage of sensitive documents, access controls limiting who can view your file, and secured physical files. We also require our service providers to protect your information by contract.

How does Abo Capital collect my personal information?
We collect your personal information, for example, when you:

  • Apply for a loan or give us your income information
  • Provide account information or give us your contact information
  • Show us your driver’s license or other identification
  • Submit a scenario through our website, chat assistant, or by phone

We also collect your personal information from others, such as credit bureaus, affiliates, or other companies.

Why can’t I limit all sharing?
Federal law gives you the right to limit only:

  • Sharing for affiliates’ everyday business purposes — information about your creditworthiness
  • Affiliates from using your information to market to you
  • Sharing for nonaffiliates to market to you

State laws and individual companies may give you additional rights to limit sharing. See the California section below.

Definitions

Affiliates. Companies related by common ownership or control. They can be financial and nonfinancial companies. Abo Capital does not share your information with affiliates for the purposes that would give you a right to opt out.

Nonaffiliates. Companies not related by common ownership or control. They can be financial and nonfinancial companies. Abo Capital does not share your information with nonaffiliates so they can market to you.

Joint marketing. A formal agreement between nonaffiliated financial companies that together market financial products or services to you. Abo Capital does not jointly market.


7. Your California Privacy Rights

7.1 California Financial Information Privacy Act

The California Financial Information Privacy Act (California Financial Code § 4050 et seq.) gives California residents additional protections regarding financial information. Because we do not share your nonpublic personal information with affiliates or nonaffiliated third parties except as necessary to process, complete, and service the transaction you requested — or as otherwise permitted by law — no additional opt-out election is required from you at this time. If our practices change, we will notify you and provide the required choices before making the change.

7.2 California Consumer Privacy Act (CCPA/CPRA)

Personal information we collect, process, or disclose in connection with a mortgage application is generally exempt from the California Consumer Privacy Act because it is subject to the Gramm-Leach-Bliley Act. That information is governed by Section 6 above.

To the extent the CCPA applies to any personal information we hold about you — for example, information collected from a general website inquiry that is unrelated to a financial product — California residents may request:

  • To know the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we shared it
  • To delete personal information we collected from you, subject to legal and recordkeeping exceptions
  • To correct inaccurate personal information
  • To opt out of sale or sharing. We do not sell or share your personal information for cross-context behavioral advertising, and we have not done so in the preceding 12 months.
  • Not to be discriminated against for exercising these rights

To make a request, email sa@abocapital.com with the subject line “California Privacy Request,” or write to us at the address in Section 1. We will verify your identity before responding, typically by confirming information already in our records. You may use an authorized agent; we will require proof of authorization.

We do not knowingly sell or share the personal information of consumers under 16 years of age.


8. Cookies and Tracking Technologies

We do not use advertising, marketing, or third-party analytics cookies on this Site. We do not run Google Analytics, Google Tag Manager, the Meta Pixel, Google Ads remarketing, LinkedIn Insight, TikTok Pixel, or session-recording tools such as Hotjar or Clarity.

The Site sets a limited number of strictly necessary cookies required for basic operation, such as:

  • WordPress session and preference cookies for logged-in administrators
  • A cookie that remembers access to any password-protected page
  • Cookies set by our contact form to preserve your entries and guard against spam submissions

The Site also loads two third-party resources that receive your IP address as a technical necessity of delivering content:

  • Google Fonts (fonts.googleapis.com / fonts.gstatic.com) — typography
  • Gravatar (secure.gravatar.com) — author avatars

Neither is used to build an advertising profile of you.

If you previously visited this Site, your browser may still hold cookies set by tools we no longer use. Those tools have been removed and no longer collect data. You can clear them through your browser’s settings at any time.

Most browsers let you refuse or delete cookies. The Site does not respond to “Do Not Track” browser signals, as no uniform standard for them has been adopted.

If we add analytics or advertising technology in the future, we will update this policy and provide a consent mechanism where required.


9. Text Messages (SMS)

If you check the text-message consent box on our contact form, you agree to receive SMS text messages from Abo Capital at the number you provide. Message frequency varies. Message and data rates may apply.

  • Consent is not a condition of any purchase or service.
  • Reply STOP to opt out. Reply HELP for help.
  • Your consent to receive text messages, and your mobile number collected for that purpose, are not shared with third parties or affiliates for their marketing purposes. We share your number with our SMS delivery provider solely to deliver messages you have asked for.

10. Email and Marketing Communications

We may send you email about your loan scenario, your application, or our services. You can opt out of non-transactional email at any time by using the unsubscribe link or by emailing sa@abocapital.com. We will still send you communications necessary to service an active application or loan.


11. Our Chat Assistant

The Site offers a chat assistant that helps identify which loan programs may fit your scenario. What you type into it is transmitted to and processed by a third-party artificial intelligence provider under contract with us, and may be retained by us to respond to your inquiry and improve the tool.

Please do not enter your Social Security number, account numbers, or other sensitive identifiers into the chat assistant. If you are ready to provide that information, we will direct you to a secure channel.


12. Loan Application Portal and Third-Party Links

Our online loan application is hosted by a third-party loan origination platform. When you follow a link to that platform, information you submit there is governed by that platform’s own privacy policy and security practices in addition to ours.

The Site also links to third-party websites and social media profiles. We are not responsible for the privacy practices of sites we do not operate. Review their policies before providing information.


13. Data Security

We maintain administrative, technical, and physical safeguards designed to protect your information, and we require our vendors to do the same by contract. The Site is served over encrypted HTTPS connections.

No method of transmission or storage is completely secure. Please do not send Social Security numbers, account numbers, or identification documents by unsecured email. Ask us for a secure upload link instead.


14. Data Retention

We retain your information for as long as needed to provide our services and to satisfy the recordkeeping obligations that apply to licensed mortgage brokers under federal and state law. Retention periods for loan files are set by those regulations and generally extend for several years after an application is closed or withdrawn. When information is no longer needed, we dispose of it securely.


15. Children’s Privacy

The Site is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us information, contact us and we will delete it.


16. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last Updated” date at the top reflects the most recent revision. Material changes affecting how we share your information will be communicated to affected applicants and customers as required by law before the change takes effect.
